in criminal cases when the commissioners are a party, and shall
receive the same fees allowed to a justice of the peace in similar
cases; and an appeal from his judgment, where the demand or
fine exceeds five dollars, may be taken to the circuit court for
Montgomery county, which shall hear and determine the matter
as upon appeals from justices of the peace.

101. Any fines, penalties and forfeitures imposed by this-
charter, or by any ordinance of the commissioners, may be col-
lected by proceedings in the name of the commissioners before
the president of the commissioners or a justice of the peace,
similar to those for the collection of small debts before justices of
the peace; and the said president or justice of the peace shall
have the power to commit the offender to the county jail, on
failure to pay such fines or forfeitures, until the same shall be
paid, with costs.

102. The commissioners shall not expend or contract to ex-
pend in any one year more money than the amount receivable-
from taxes and other sources for that year.

103. The county commissioners, justices of the peace, sheriff,
constables and all other county and State officers, shall have,
hold and exercise their offices and jurisdiction in said town
as if this charter had not been granted; and the county com-
missioners shall appropriate annually one-half of the tax, levied
or imposed upon the assessable property within the corporate
limits of the town, for the improvement of the streets within
the corporate limits of the town, and shall order the county
collectors, who shall collect the taxes within said corporate
limits, to pay said one-half thereof to the commissioners of
said town for that purpose.

104. They shall have power to establish building lines on all
the streets in said town, or which shall hereafter be opened
therein, and to compel all persons hereafter erecting buildings in.
