1262 GARRETT COUNTY. [ART. 12.

penalties received by any justice under the provisions of section
136 shall be accounted for and wholly paid, without abatement
or deduction therefrom by such justice, to the county commis-
sioners of the county wherein they are collected/f or the use of
said county; and no part of any fine or penalty enforced or col-
lected under said section shall be paid to any informer.

LIQUOR AND .INTOXICATING DRINKS.

1886, ch. 241.-

139. It shall not be lawful for any person, house, corporation,
company or association, to sell spirituous or fermented liquors, or
alcoholic liquors or alcoholic bitters, directly or indirectly, at any
place within the limits of Garrett county.

140. If any person, house, company, association or body politic
shall sell, directly or indirectly, any spirituous or fermented
liquors or alcoholic bitters, within the limits of said county, he,
they or it, shall, on conviction thereof, forfeit and pay a fine of
not less than fifty dollars nor more than three hundred dollars
and costs of prosecution, or instead of such fine, be imprisoned in
the county jail for sixty days, or until discharged by due process
of law, or both, in the discretion of the court.

141. Nothing contained in the two preceding sections shall be
construed to prevent the compounding or sale of any such liquors
for medicinal purposes by a pharmacist and druggist, who shall
or may obtain a license under the license laws of this State, for
the prosecution of the business of pharmacy, and upon a written
bona fide prescription of a regular practising physician, whose
name shall be signed thereto; and all such prescriptions shall be
filed and kept by such pharmacist and druggist; and no prescrip-
tion shall serve for more than one purchase; but no physician
shall make or sign any such prescription unless the person for
whom it is made is actually sick, and such liquor is deemed by
said physician necessary as a medicine; any physician who shall
make or sign any prescription for liquor, except as aforesaid, shall
be deemed guilty of a violation of said sections, and on conviction
