1208 FREDERICK COUNTY. [ART. 11.

five cents for every day it shall have been impounded, and for
every goose the sum of twelve and a half cents, the person
impounding may sell or kill the same for his own benefit.

443. If any person shall be sued for killing any swine, geese
or poultry, under either of the three preceding sections, he may
plead the general issue, and give the special matter in evidence.

444. It shall not be lawful for any person to allow his or her
swine to run at large in the roads, streets or alleys, within one-
half of a mile of the square in the village of Burkittsville, or in
the village of Knoxville, under a penalty to the owner thereof in
the sum of fifty cents for each swine found within the said limits.

445. If any person finding any swine going at large withia
the prescribed limits of the preceding section, shall furnish such
information under oath or affirmation, together with the name of
the owner, to a justice of the peace in Petersville district, the said
justice of the peace shall issue a summons to the owner to appear
before him to answer in a plea of trespass; and if it shall appear
upon satisfactory proof that the swine of such person charged in
the summons has been found within the limits prescribed in the
preceding section, the justice of the peace shall render judgment
against the owner in the sum prescribed in said section, together
with all costs incurred, to be collected as other small debts.

446. It shall be lawful for any person finding swine running
at large, in violation of secton 444, to impound such swine, and
after giving five days' notice by writing, in at least two public
places in Burkittsville or Knoxville, he may sell such swine to the
highest bidder for cash; and should such swine be claimed by the
owner, he shall pay twenty-five cents for every day said swine has
been impounded, together with the fine and costs, as prescribed in
said section, and in default of payment of the said fine and im-
pounding fee, the said swine may be sold to satisfy the same.
