1186 FREDERICK COUNTY. [ART. 11.

Frederick county, and also pay and satisfy the president, in case
the judgment of the president shall be affirmed, as well the fine
and costs adjudged by the president as also all costs that shall be
awarded by the court, then the bond to be and remain in full
force and virtue, otherwise to be of none effect; and no such
appeal shall be heard by the court until such bond shall be given
and approved as aforesaid, and filed with the clerk of the court.

MIDDLETOWN.

351. The citizens of Middletown, Seller's addition to Middle-
town, Grove's addition to Middletown, and Wise's addition to
Middletown, in Frederick county, are a body corporate by the
name of "The Burgess and Commissioners of Middletown," and
by that name may sue and be sued, and may have and use a
common seal.

352. The bounds of said town shall be as described in the plat
thereof, on record in the office of the clerk of the circuit court for
Frederick county.

353. The male citizens of Middletown, of the age of twenty-
one years and upwards, who shall have resided in said town for
six months next preceding the election, shall elect, by ballot, on
the first Monday in April, annually, a burgess and five commis-
sioners, who shall have resided within the said town twelve
months next preceding the election.

354. All elections shall be held and conducted as shall from
time to time be directed by the by-laws of the corporation, not
inconsistent with this sub-title of this article.

355. The burgess shall qualify by taking and subscribing the
oath of office before the clerk of the circuit court, or before one
of his sworn deputies; and the commissioners and all other
