1870. ch. 98.
341. The president of said commissioners, and all other
officers of said town, before they enter upon the duties of their
respective offices, shall severally take the following oath or
affirmation: "I do solemnly swear or affirm that I will faithfully
execute the office of ———— to the best of my knowledge and
ability, without favor, affection or partiality."

342. The president of the said commissioners, in virtue of his
office, shall have and exercise within the limits of the town, all
the jurisdiction and power of a justice of the peace, except as to
the recovery of small debts; he may call on the officer of the
village entrusted with the receipt and expenditure of public
money, for a statement of his accounts as often as he shall
think proper; he shall see that the ordinances are faithfully
executed, and report to the board of commissioners, at their stated
meetings, the general state of the village, and may call special
meetings of the commissioners whenever he may see proper.

343. The board of commissioners may, at discretion, levy
upon the assessable property of the corporation one hundred
dollars, and pay the same over to the county commissioners, to
aid in keeping the streets, as part of the public roads, in good
repair.

344 If the inhabitants of the village at any time neglect to
make an election as herein directed, the power of electing com-
missioners shall not thereupon cease, but shall continue as though
such election had been made, and the president and commis-
sioners for the time being shall remain in office until such annual
election shall be held.

345. The commissioners may impose and appropriate fines,
penalties and forfeitures for the breach of their ordinances.
