1174 FREDERICK COUNTY [ART. 11.

make or sign any prescription for such liquor, except as aforesaid,
shall be deemed guilty of a violation of said sections, and upon
conviction thereof shall be fined not less than fifty dollars nor
more than two hundred dollars for the first offence, and not less
than two hundred dollars, nor more than five hundred dollars for
each subsequent offence, one-half of said fine to be paid to the
informer and the balance to be paid to the board of public school
commissioners of said county, for the use of the said public
schools, and be committed to the county jail until such fine and
costs of the same are paid; nor shall anything herein be construed
to prohibit a sale by such pharmacist or druggist, in case of
extreme illness, when delays may be dangerous to the patient.

1874, ch. 130.

303. The clerk of the circuit court shall not grant a license to
any person to sell spirituous or fermented liquors of any kind at
any time or place within two and one-half miles of " Brook Hill
Meeting House;" and any person selling any kind of intoxicating
drinks, whether of original manufacture or of a mixed character,
within the above described limits shall, on conviction thereof, be
subject to all the fines and penalties provided by article 56 of
the code of public general laws title "Licenses" for selling
spirituous or fermented liquors without license.

1874, ch. 285.

304. The clerk of the circuit court shall not grant a license to
any person to sell spirituous, vinous or malt liquors of any kind,
at anytime or place within three miles of the post-office, in the

village of Hansonville; and any person selling any kind of in-
toxicating drinks within the above described limits, shall, on con-
viction thereof, be subject to the fines and penalties prescribed by

said article 56 of the code of public general laws title " Licenses"
for selling spirituous or fermented liquors without license.

1886, ch. 420.

305. It shall not be lawful for the clerk of the circuit court
to issue license to any person to sell spirituous or fermented
liquors or lager beer at Buckeystown, or at any place nearer than
two miles in every direction from Buckeystown, unless for medici-
nal purposes, and upon the prescription of a regular physician
