peace shall not be stayed, unless the party appealing shall give
bond to the State for double the amount of the fine imposed,
with security approved by the justice rendering the judgment,
with condition to prosecute his appeal with effect, or to pay the
fine imposed, with all costs.

150. It shall be unlawful for any person to take, catch or de-
stroy any fish in any manner during the month of May in the
waters of Frederick county; provided, that the Potomac river
shall be exempted from the provisions of this section.

151. Any person violating the preceding section shall, upon
conviction before any justice of the peace of said county, be
liable to a fine of not less than five nor more than ten dollars for
each offence; and upon failure to pay such fine and costs of
prosecution, shall be sentenced to imprisonment in the county
jail for a period not exceeding ten days; said fine to be paid,
one-half to the informer and the other half to the county com-
missioners for the use of the county; provided, however, that
any person so convicted shall have the right of appeal to the
circuit court for the county.

152. Frederick and Montgomery counties are exempted from
the operation of sections 40-46 of article 39 of the code of public
general laws, title " Fish and Fisheries," sub-title " Potomac;"
provided, that such exemption shall not apply to "sledging" or
killing fish with poison or drug, or by the explosion of powder
or other substance, or to the provisions of sections 42, 43, 44
and 45 of said article, relating to fishways.
