242. The proceeds of sale of property condemned, and all
fines imposed and collected under the provisions of the three pre-
ceding sections, after paying the coste and expenses of arrest,
seizure, condemnation and sale, shall be divided and paid over,
one-fourth thereof to the sheriff or constable making the arrest;
one-fourth thereof to those aiding in making the same, and the
remaining half thereof to the board of county school commis-
sioners, for the use of the public schools of the county.

243. Any party against whom any justice of the peace shall
render a judgment under the provisions of section 241 may, at
any time within twenty days from the rendition thereof, appeal
from such judgment to the circuit court for said county; but no
execution or sale shall be stayed unless the party appealing shall
give bond to the State of Maryland in double the amount of the
fine imposed or value of the property condemned, with security to
be approved by the said justice of the peace, with condition to
prosecute such appeal with effect, and to pay the parties entitled
to the same the value of the property condemned or amount of
:fine imposed, and all costs attending such proceeding, in case judg-
ment shall be affirmed; and in all cases of appeal under the
provisions of this section either party shall be entitled to trial by
jury.

244. The clerk of the circuit court for Dorchester and Talbot
counties, respectively, shall, upon the application of any person who
has been a resident of such counties for twelve months next pre-
ceding such application, and to no other person, issue a license to
such resident to employ any boat of the capacity of ten tons, or
under such capacity, to be ascertained by custom-house measure-
ment, in taking or catching oysters with dredge, scoop or scrape,
in the waters of the Choptank river, in said counties, for sale to
any person, between the first day of October in each year and the
iirst day of April next following; provided, that nothing in this
section shall authorize the taking of oysters with scoop, scrape or
dredge above a straight line drawn from the long wharf at Cam-
bridge, known as " Thomas " wharf, on the Dorchester shore, to
