972 MANURES AND FERTILIZERS. [ART. 61.

1870. ch. 426, sec. 4.

7. The words " commercial manures, artificially manufactured

or manipulated fertilizers," shall be taken and construed to
include all manures and fertilizers which shall be sold for a
greater price than one cent per pound; and any arrangemant or
agreement, verbal or written, made by and between any seller
rand purchaser of said manures or fertilizers, for the purpose of

exonerating the seller or manufacturer from liability for a vio-
lation of any of the provisions of this article, shall not exempt

such seller, manufacturer, compounder, preparer or furnisher of

said manures or fertilizers from indictment and fine as is herein-
before provided for. Nothing in the provisions of this article
shall prevent the buyer and seller from making contracts in ref-

erence to the price to be paid or the quality of the fertilizer con-
tracted for.

8. By the term soluble phosphoric acid, whenever used in this
article, is meant phosphoric acid in any form or combination
readily soluble in pure cold water; and by the term insoluble
phosphoric acid is meant phosphoric acid in any form or com-
bination which requires the action, of an acid upon it to cause it
to become readily soluble in pure cold water.

9. Any manufacturer, dealer, agent or other person who
shall adulterate, add to or take anything from any commer-
cial manures or artificially manufactured or manipulated fertil-
izers, labeled in accordance with the provisions of this article, or
who shall use the brand or trade mark of any manufacturer or

dealer other than his own, shall be deemed guilty of a misde-
meanor, and shall, upon conviction thereof in any court having
jurisdiction, be punished by a fine not exceeding one hundred

dollars, or imprisonment in jail not exceeding six months, or by
both fine and imprisonment, at the discretion of the court before

whom he shall be tried.
