conviction on indictment in the courts of this State having crimi-
nal jurisdiction of the offence, shall be fined not less than five
hundred dollars nor more than one thousand dollars, or imprisoned
an the penitentiary for not less than one nor more than five years.

117. Any person or persons, firm, corporation, agent or agents,

making sale of any of the seed or products named in the four
preceding sections by false or fraudulent representations as to its

quality or productiveness, or shall sell or offer to sell the same by

any artifice or device whereby the purchaser may be deceived,
shall be guilty of a misdemeanor, and, upon conviction on indict-
ment, shall be fined not less than one hundred dollars nor more
than five hundred dollars for each offence, or imprisoned in the
Maryland house of correction for not less than six months nor
more than two years, or be both fined and imprisoned in the dis-
cretion of the court.

118. In every special partnership, general partners shall be
liable to account to each other and to special partners, for the
management of the concerns both in law and equity, as other

partners now are by law; and every partner who shall be guilty

of fraud in the management of the affairs of the partnership,
shall be liable civilly to the party injured to the extent of his

damages, and shall also be liable to an indictment for a misde-
meanor, punishable by fine or imprisonment, or both, in the dis-
cretion of the court by which he shall be tried.
