violation of the provisions of said sections of this article; and
until said matter is determined, the said examiner shall retain,
in his custody said goods, and shall not destroy the same; and
if the decision is in favor of the petitioner, the said goods shall
be returned to said petitioner by said examiner, and the costs,
shall be taxed and paid as in criminal cases; but if the decision
is in favor of the examiner, said goods shall be destroyed by
said examiner, and the costs of the proceedings shall be paid by
the petitioner. The State's attorney of the several counties and
Baltimore city shall appear on behalf of said examiner in said
proceedings.

54. All persons, firms, joint stock companies or corporations
who use shell oysters for packing as hermetically sealed cove
oysters, as a condition upon which they shall be permitted by the
State to carry on said business, shall render a sworn statement at
the end of each month to the comptroller of the State treasury,
of the number of bushels of such oysters so used, and at the same
time pay into the State treasury one-tenth of one cent per bushel
for each and every bushel of such oysters used for said purpose,
to constitute a fund to be called the "oysters packers' fund,"
from which the said persons so as aforesaid appointed examiners
shall be paid the salary and allowances hereinafter provided, if
and so long as the same may be sufficient for that purpose.

55. The said examiners shall, at the end of each month, make
a sworn statement to the comptroller of the treasury, of the
amount of expense, not personal, necessarily incurred in the dis-
charge of their duties under sections 51-54 of this article; and
the comptroller of the treasury shall thereupon draw his warrant
on the treasury to the order of said examiners for the payment
ot the same, together with one hundred and twenty-five dollars as
monthly salary of each of such examiners, provided there be in the
treasury funds to the credit of the fund aforesaid sufficient to pay
the same.
