37. Any manufacturer, dealer, agent, or other person or persons
who shall adulterate, add to, or take anything from, any commercial
manures or artificially manufactured or manipulated fertilizers
labelled in accordance with the provisions of this act, or who shall
use the brand or trade-mark of any manufacturer or dealer other
than his own, shall be deemed guilty of a misdemeanor, and shall,
upon conviction thereof in any court having jurisdiction, be pun-
ished by a fine not exceeding one hundred dollars, and imprison-
ment in jail not exceeding six months, or by both fine and imprison-
ment, at the discretion of the court before whom he shall be tried.

38. All oils or fluids manufactured from petroleum or its pro-
ducts, used for illuminating purposes in this State, which shall be
manufactured or kept for sale therein, shall be required to stand a
fire-test of one hundred and ten degrees Fahrenheit before it shall
burn, to be ascertained by Tagliabue's coal oil tester, or some other
instrument constructed upon the same principle.

39. Every person manufacturing or selling illuminating oils or
fluids, manufactured from petroleum or its products, by the barrel,
shall be required to have stamped upon the head of the barrel the
name of the manufacturer thereof and his place of business, to-
gether with the words, " warranted to stand a fire-test of one hundred
and ten degrees Fahrenheit before it shall burn. "

40. Whoever manufactures for illuminating purposes, or sells in
quantities not less than a barrel, oils or fluids made from petroleum
or its products, which does not sustain the fire-test provided for in
section thirty-eight hereof, shall be deemed guilty of a misdemeanor,
and on conviction thereof, shall be fined not more than one thousand
dollars, or imprisoned in the jail or penitentiary not more than two
years, in the discretion of the court; whoever sells in quantities less
than a barrel for illuminating purposes, oils or fluids made from petro-
leum or its products, which does not sustain the fire-test provided
for in section two of this act, shall forfeit said oil, and be fined not
less than five nor more than twenty dollars, said fine to be collected
as other fines are now collected; one-half to go to the informer, the
other to be paid into the treasury of the State.

41. Any purchaser of oils or fluids made of petroleum or its
product for illuminating purposes, bearing the stamp required in
section three of this act, and which does not stand the fire-test re-
quired in section two, may recover from the seller in an action for
debt an amount equal to double the purchase-money of said oil.

42. Any accident by reason of explosion, occurring with any oil
or fluid manufactured from petroleum or its products, shall subject
