Election

77. There shall, at each general election for delegates to the
General Assembly, be elected by the qualified voters of each elec-
tion district in the several counties of this State, one road super-
visor, n ho shall be a qualified voter and a resident of the district,

whose duty it shall be to superintend and direct the repairs of the
public county roads and bridges within his election district, in such
manner, and under such regulations and restrictions, as may be di-
rected by the county commissioners.

78. The sheriff of each county shall give public notice of the
election of road supervisors, in the same manner and at the same
time as of other public elections.

made

79. The return judge of each election district shall make the
returns for the election of road supervisors, at the same time and in
the same manner as other election returns.

made, shall certify to the county commissioners who has been re-
turned as having received the highest number of votes for road
supervisor in each election district of the county.

8 ! Upon receiving such certificate, the county commissioners
shall issue to each elected supervisor a commission setting forth the
time for which, and the election district of which he has been elected
road supervisor, and the amount of compensation he shall be entitled
to receive, the amount of money, if any, appropriated for the repair
of the roads and bridges which may be in his supervision, and setting
forth also the time at which he shall report, and such other regula-
tions and restrictions as they may adopt in relation to said office or
officer.

82. The sheriff of each county shall deliver the commissions, to
the several road supervisors within his county, within twenty days
after they are delivered to him, under the penalty of twenty dollars,
to be paid to the county, for each neglect.

Case of tie

83. In the event of a tie between any two or more candidates
for road supervisor for the same election district, the judges of elec-
tion shall so return, and the clerk of the Circuit Court shall so cer-
tify to the county commissioners, who shall, in their discretion, com-
mission one of the tie candidates as road supervisor.

8 4. Each road supervisor shall take and subscribe the oath pre-
scribed by the Constitution and laws.

Term of office

85. The term of office of road supervisor shall begin on the first
day of January ensuing his election, and shall continue for two years
