ART. 12. ] LICENSES.
Court of Common Pleas of the city of Baltimore, if the said busi-
ness is proposed to be done in said city, the sum of twelve dollars
for a license to do said business for one year, or a proportionate
part of said sum for any fractional part of a year, not less than one
month; and all licenses so issued shall be made to expire on the first
day of May next succeeding the date of their issue.

40. Any person offending in any way by violating the provisions
of the last preceding section, either as agent or otherwise, shall be
liable to a prosecution therefor, and upon indictment and conviction
thereof in any court having jurisdiction, shall be fined not less than
twenty nor more than one hundred dollars, and shall stand com-
mitted until the fine and costs are paid.

41. No person or corporation within this State other than the
grower, maker, or manufacturer, shall barter or sell any goods, chat-
tels, wares, or merchandise without first obtaining a license in the

manner herein prescribed; Provided, persons carrying on the shad
and herring fisheries in this State, may sell and dispose of so much
salt as may be necessary to cure the fish purchased of them during
the months of March, April, and May, and no longer, without
license; and that nothing herein contained shall extend to vendors

such beer or cider; but nothing herein shall exempt the establish-
ment of lager beer or the vendors thereof.

42. When any person, body politic, or corporate, shall propose
to sell or barter anything mentioned in the preceding section, except
spirituous or fermented liquors, he shall apply to the clerk of the
Circuit Court of the county in which he may reside, or if he resides
in the city of Baltimore, to the Court of Common Pleas, for a license
therefor; but no license to trade, or to sell spirituous or fermented

liquors, shall be issued by any clerk of a court to a feme covert or
to a person under the age of twenty-one years, without the1 special
order of the judge of the court; but no judge shall give such special
order to issue license to sell spirituous or fermented liquors, unless
upon the recommendation of at least ten respectable freeholders,
residents of the ward or district wherein the place of sale may be,
and whenever any license shall be issued to a feme covert, or minor,

the said feme covert or minor shall be responsible for all contracts
made in the prosecution of their business under such license, and
shall be liable to be sued therefor in any of the courts of this State;

in case of a violation by her of the license laws of this State, or in
case she should keep a disorderly house, as if she were a feme sole;
