in such case he is hereby vested with the full power
and authority to make all needful rules and regulations
therefor, which rules and regulations shall have the
force of law.

3. At all times the commander-in-chief is hereby
authorized to make and publish all needful rules and
regulations for the control, discipline, armament and
equipment of the militia, to carry out the provisions

practicable, conform to the laws and regulations gov-
erning the organizing of the United States volunteer
forces, their discipline, armament, equipment and offi-
cers, and which rules and regulations shall have the
force of law.

4. The enrolment and organization of the militia
of this state into divisions, brigades, regiments, bat-
talions, squadrons, batteries and companies, as num-
bered and recorded in the office of the adjutant general
shall continue, subject to be altered by the commander-
in-chief from time to time, as he may direct.

formed.

5. Whenever a sufficient number of the militia shall
meet together and declare their purpose in writing to
form a volunteer company, by subscribing their names
to an agreement to that effect, they may proceed to
elect company officers as provided in section nine of
this article, provided their numbers shall not consist of
less than forty nor more than eighty persons. The
captain elect shall thereupon transmit to the adjutant
general the original agreement signed by the members
proposing to organize said company, together with the
proceedings of the meeting held of the election, duly
attested by its chairman and secretary ; and whenever
the said officers elect are commissioned by the gov-
ernor as provided in section ten, and the oaths of
office as provided in section twenty-three of this arti-
cle, shall have been taken and subscribed by the mem-
bers thereof, said organization shall be a legally organ-
ized volunteer company of the militia of this state,
subject to the requirements, and entitled to all the
benefits and privileges of this Act.
