ART. 21. ] WASHINGTON COUNTY.

Washington county, any body of water that may be
sufficient and necessary for a full supply for said town,
and may convey the same in such manner and direc-
tion as the said corporation may think proper, and
said corporation may purchase and hold all such land,
tenements, goods and chattels as may be necessary to
carry into effect the provisions of this act, and may
grant and allow the same, may make and lay conduits
or pipes for the conveyance of said water under and
along the public highways, streets, lanes, alleys and
side pavements or any of them, of the county of Wash-
ington or town of Smithsburg, for the purpose of con-
veying and distributing said water, and may from time
to time renew and repair the same, and may establish
reservoirs and public fountains in such parts of the
streets and squares of said town as they may think
proper, and may grant to all persons and corporate
bodies the privilege of using said water in such man-
ner and upon such terms, and in such quantities as
they may think proper; they may insert and repair,
at the expense of the town, such number of fire-plugs
as they may deem necessary into the pipes used to con-
vey water through the streets of said town, to be used
only in case of fire, but free from any charge therefor;
they may convey said water in such manner and by
such route as they may deem proper, and they may
appropriate such and so much land as may be neces-
sary and proper, or the location and construction of
any work or building appurtenant to said water works,
and any spring that may be necessary for furnishing a
full supply of water by furnishing a hydrant for the
use of any tenement or dwelling that had previously
been supplied from said spring.

342. If compensation shall be required by any per-
son whose rights may be affected by the conveyance of
said water or the appropriation of land or springs, and
such person shall not be able to agree with said cor-
poration upon the amount of such compensation, or if
the owners or any of them be feme covert, under age,
non compos mentis, or out of the county, application
