ART. 71.] OYSTERS.

right and proper position, securely attached to the sails,
and worn at all times during the dredging season, and
shall not be concealed, defaced or injured, and no other
number but the proper one shall be exposed to view on
a licensed vessel, nor shall any number other than that
which is furnished by the comptroller be used; any
captain of a licensed vessel who shall violate the pro-
visions of this section, in whole or in part, shall, upon
conviction thereof before any justice of the peace or a
judge of a circuit court for this state, most convenient

or accessible, pay a fine of not less than one hundred
nor more than two hundred dollars ; and iu case the
captain shall be found to be an irresponsible party,
then the vessel shall be liable for the payment of the
fine and costs.

Penalty.

32. The sum of six thousand dollars is hereby
appropriated to purchase or build two suitable sail-
vessels, and to arm and equip the same for the ser-
vice hereinafter specified, which, together with the

steamer, shall be styled the state oyster police force ;
and the governor, treasurer, comptroller, superintend-
ent of labor and agriculture, and the clerk of the court
of appeals shall constitute a board, to be styled the

commissioners of the state oyster police force; and
they are directed to purchase, arm and equip said ves-
sels ; provided, that the board aforesaid shall, under no
circumstances, exceed the above appropriation ; and the
treasurer of the state, upon the requisition of said com-
missioners and the warrant of the comptroller is hereby
directed to pay the sum or sums necessary, not exceed-
ing this, or any other appropriation hereinafter men-
tioned, for the purposes herein specified.

Proviso.

33. The board of commissioners of the state oyster
police force shall have power to appoint a suitable per-
son to command said force, whose term of office shall
be for two years, unless sooner removed, for incompe-
tency or neglect of duty ; and if said officer shall fail
to discharge his duty, by reason of collusion with those
interested in evading the law, he shall, upon present-
ment, indictment, and conviction in a court of law, be
