that the successors of the present governor, in ap-
pointing inspectors, as aforesaid, shall select four
of them from the tobacco growing counties of the
state ; no two of whom shall be selected from the
same county.

496. Each of said tobacco inspectors before pro-
ceeding to act, shall take and subscribe before the
clerk of the superior court of Baltimore city, an oath
or affirmation that he will faithfully to the best of
his ability without fear, favor or partiality, discharge
all the duties of tobacco inspector, and shall also

give bond to the state of Maryland, in the penalty of
thirty thousand dollars, with at least two securities
to be executed in the presence of, and attested by
said clerk, and approved by the comptroller, condi-
tioned for the faithful performance of all his duties
as tobacco inspector, and lodge the same with the
approval of the comptroller endorsed thereon, with
the clerk of said court, whose duty it shall be to re-
cord the same and a copy thereof, under the seal of
said court, shall in all suits on said bond be good
and sufficient evidence thereof, and of its execution
by all the parties thereto.

, 497. Any person or persons on filing a declaration,
stating in general terms, his, her, or their ground of
action against any tobacco inspector as such, may
require a writ or writs in the name of the state, as
plaintiff, endorsed to the use of such person or per-
sons, to be issued against any suck tobacco inspector,
and the sureties on his bond, accompanied with a
copy or copies of such declaration, to be served with
said writ or writs on the defendants, and may in such
suit recover judgment for such damages as he, she or
they may show him, or herself, or themselves, to
have suffered by reason of any malfeasance, misfeas-
ance, or neglect of duty on the part of such tobacco
inspector, together with the costs of suit, and in any
such suit any of the proceedings may be amended as
in other cases.
