Excess of fees,
how disposed
of

152. If any excess of fees should accrue in the
office of the clerk of the circuit court for Baltimore
county during the time of carrying into effect and
executing the provisions of this act, the said clerk is
hereby authorized and directed to pay the same to
the treasurer of Baltimore county and take his receipt
for the same, and the said treasurer is hereby — and
required to place the amount or amounts thus re-
ceived, to the credit of the fund authorized and
appropriated by this act, and such excess of fees if
any should accrue are hereby dedicated and appro-
priated to that object, and the comptroller of the
state is hereby directed upon the presentation to
him by the said clerk of such receipt or receipts
from the said treasurer for such excess of fees to settle
the accounts and credits of the said clerk accordingly.

former com-
missioners

153. It shall be the duty of any person who has
possession of any book of proceedings or papers be-
longing to, or which was used by any of the former
commissioners of records, to deliver the same to the
commissioner appointed by this act, and the said
commissioner is hereby authorized and required to
examine the books and proceedings and work done
or ordered to be done by any or either of the com-
missioners of records heretofore appointed and to
supply any omission if any there be, and the action
of the said commissioner in the premises shall be as
valid and have the same effect in law as if such
omission had not occurred, and during the exist-
ence or at the close of this commission all the par-
tially burnt indexes, records, dockets, papers and
instruments of writing which may have been re-
newed by the substitution of others correspondent
thereto, shall be properly endorsed by the said com-
missioner, and after such endorsement it shall be
the duty of the clerk of the said circuit court to
file the same away to be preserved as other records
and papers are preserved in said office.
