334 ALLEGANY COUNTY. [ART. 1.

the qualified voters in said town, at said election shall vote in favor of an incorpora-
tion, then the provision of this act shall take effect, and the election thereunder shall
be valid j but if a majority of said voters shall vote against an incorporation, then
this act be held as utterly null and void, and the acts and sections to which this is
a supplement, shall also be null and void, and there shall be no more elections held
in said town under its charter of incorporation, and all provisions of law incorpor-
ating said town shall be void. 1S66, c. 47 ID force from February 7, 1866, and 1867,

1861, c. 99 enacts the following:

Incorporated.

94. The citizens of the town of Grantsville, in
Allegany county, are hereby constituted and made
a body corporate, by the name of the commissioners
of Grantsville, with all the privileges of a body cor-
porate, and to have a common seal and perpetual
succession.

95. The free male white citizens of Grantsville,
i aforesaid, of the age of twenty-one years and up-
wards, being citizens of the United States, who have
resided in the said town for and during the space of
six months, next preceding the first Monday in May
eighteen hundred and sixty-four, may on that day,
at the usual place of holding elections in the said
town, and on the first Monday in June in each and
every year thereafter, at such house as shall here-
after be designated by the municipality, be author-
ized to elect five commissioners for said town, who
shall have resided within the limits of the same, six
months next preceding the election.

96. A justice of the peace, for the time being,
residing in the said town, shall appoint, by writing
under his hand and seal, three judges to hold the
first election, who shall keep the polls open from
nine o'clock in the morning until five in the after-
noon, and shall conduct the said election in the
same manner in which the judges of election are
now directed to conduct an election for delegates to
the general assembly, as far as may be consistent
with the provisions of this act ; and the said judges
shall make return, under their hands and seals, of
