published in some newspaper printed in the city of
Cumberland, and notice posted in said town of the
manner, time, place and terms of sale, sell the part
or parts of said property, lot or lots so laid off, at
public sale for cash, after deducting the expenses of
advertising and sale and paying the sums levied as
aforesaid, shall pay the balance if any over to the
owner of the property so sold; and the guardian of
an infant or infant owners shall have full power on
behalf of his ward or wards to make application
under this section, and the mayor and councilmen
shall execute and deliver to the purchaser a deed
of the property sold with the seal of the said town
affixed, and it shall convey the title to the purchaser.

Fines, how
recovered.
|
91. All fines, penalties, or forfeitures imposed by
this charter, or any ordinance of said town may be
recovered in the name of the mayor and councilmen
of said town, before any justice of the peace as small
debts, and shall be paid to the mayor and council-
men for the use of the town.

Driving car-
riage, &c , over
pavement.

92. No person shall drive any carriage, wagon or
vehicle of any description, or ride any horse upon or
over the paved footway of the said town, under the

penalty of two dollars for every such offence; and
any constable or the bailiff of said town, shall arrest
any person so offending and take him before a jus-
tice of the peace, who upon proof of the offence, shall
give judgment in the name of the state against the
offender, upon which there shall be no supersedeas,
and the fine shall be collected and paid to the mayor
and councilmen for the use of said town ; and the
bailiff shall have the same power and receive the
same fees as constables in Allegany county, for mak-
ing arrests or serving any process for violation of
the ordinances of said town.
