visions, and the said officer so commissioned, shall
have power to summon to his aid such number of
persons, not exceeding twenty, may, in his judg-
ment, be necessary to the proper and sole execution
of his commission.

Duty of officer
in command
of steamer.

23. It shall be the duty of any officer having
charge of or commanding such steamer, to take the
person or persons so arrested, and the boat or boats,
vessel or vessels, and other property so seized into
his custody, and cause the said person or persons
to be taken before some justice of the peace for the
county wherein the offence may have been com-
mitted ; and if the offence shall have been committed
outside of the limits of any county, then to take the
said person or persons before some justice of the
peace of the county lying opposite, and most con-
venient of access from the place where such offence
shall have been committed ; and it shall be the duty
of the justice of the peace, before whom such person
or persons shall be taken by said officer, to take
cognizance of the same, and docket a case or cases in
the name of the state against such person or persons,
and the said boat or vessel, and the said justice shall
proceed to try the same and render judgment as pro-
vided by this Article.

24. It shall be the duty of any officer commis-
sioned under section twenty-two of this article, to
- return to the comptroller, at the expiration of such
cruise, the said commission, with a full and particular
account of his proceedings thereunder, and the names
of the persons summoned to aid in its execution,
whereupon, the comptroller shall issue his warrant

to the treasurer for the payment to such officer, such
sum not exceeding five dollars per diem, as may, in
the judgment of said comptroller, be deemed a fair
equivalent for the services performed, and to each of
the persons summoned by and aiding such officer, a
sum not exceeding three dollars per day, for every
such person who may have been actually engaged in
such service; and in addition thereto, such officer
