the army of the United States, and other persons
in official stations, on the subject of military affairs,
and keep a record of such correspondence ; he shall
annually make a return in triplicate of all the militia
of the state, one copy whereof he shall deliver to
the commander-in-chief on or before the first day of
January; one copy shall be transmitted to the adju-
tant-general of the United States army on or before
the first day of February thereafter, and one copy
shall be filed in his office, he shall receive and file all
returns made to him according to law and regulation,
and annually make a detailed report thereof to the
commander-in-chief, and perform such other duties
as may properly belong to. his office or which may
be prescribed by the military board or commander-
in-chief, and to aid him in the discharge of his duties,

Election and
appointment
of officers.

11. All regimental and battalion officers shall
be elected by the commissioned officers of the com-
panies composing said regiments or battalions, all
general officers of brigades or divisions shall be
elected by the commanding officers of the regiments
comprising said brigades or divisions, company offi-
cers shall be elected by the ballots of the members
of their respective companies ; the non-commissioned
staff shall be appointed by the commanding officer
of the respective regiments or battalions, non-com-
missioned officers of companies shall be elected by
the ballots of their respective companies, warrants
for non-commissioned officers shall be issued by the
rigimental or battalion (or independent company)
