lected by any constable in the district where such
offence may have been committed, in the same man-
ner of other small debts ; one-half of said fine shall
be paid to the informer, and the other half into the

public school fund of Worcester county ; provided,
that nothing herein contained shall be intended to
apply to any of the waters of said river, below a
point called and known by the name of Porter's
Bridge.

Proviso.

26. Any person deeming himself or herself .ag-
grieved by any judgment of a justice of the peace
under this act, shall be entitled to an appeal to the
circuit court of the county, as in other cases of appeal
from judgments of justices of the peace.

senger : compensation and duties.

24. Vacancies in office filled by governor.

1862, c. 226 amends and re-enacts section 5 as follows :

 

SEC. 5. The governor may appoint a messenger to
the executive, who shall be the keeper of the water
closets attached to the state house, and shall keep
the same cleaned, ventilated and supplied with water,
and in every respect in thorough order, who shall
hold his office at the pleasure of the governor, and
shall receive an annual salary of five hundred dollars.
