ART. 85.] ELECTIONS.

to the secretary of state, and in the case of state's attor-
neys, shall be transmitted to the judge of the court
having criminal jurisdiction in the circuit in which
state's attorneys are respectively elected ; and from the

returns so made, the governor shall issue commissions
to the different persons elected, including the lieuten-
ant governor, as provided in the fourteenth section of
the fourth article of the constitution of this state.

32. The said certificates for all officers provided for
by the constitution, except in tie case of the gov-
ernor and state's attorneys, shall be directed to the
governor ; for the governor, they shall be addressed
to the speaker of the house of delegates, and enclosed
to the secretary of state ; for state's attorneys, they
shall be addressed to the judge of the court having
criminal jurisdiction in the county or city.

BAB ROOMS ON ELECTION DAYS.

1865, c. 191 enacts the following :

 

46. It shall not be lawful for the keeper of any
hotel, tavern, store, drinking establishment, or any
other place where liquors are sold, or for any person
or persons, directly or indirectly, to sell, barter, or
give or dispose of any spirituous or fermented liquors,
ale or beer, or intoxicating drinks of any kind, on the
day of any election hereafter to be held in the seve-
ral counties of the state.

47. Any person violating the provisions of this act
shall be liable to indictment by the grand jury of the
county where the offence is committed, and shall
upon conviction before any judge of any of the cir-
cuit courts of this state, be fined a sum not less than
fifty dollars, nor more than one hundred dollars, for
each and every offence ; one-half of the fine shall be
paid the informer, the other half to the county com-
missioners for the use of public roads.
