74 PUBLIC INSTRUCTION. [ART.

the case, and if they deem it expedient, they may sell and con-
vey the said school house and lands and appropriate the avails
to the erection of another school house upon such site as they
may select.

42. No school house shall be used for any other than public
school purposes and school district meetings, without the con-
sent first obtained of the district commissioner. The location of
school houses in the city of Baltimore, and all matters connected
with the building and furnishing thereof are to be decided by
the Mayor and City Council, or by the board of commissioners
for schools in the city of Baltimore, if the Mayor and Council
so direct.

SCHOOL HOUSE SITES.

43. It shall be the duty of the district commissioners, with
the consent of the board, to select a suitable school house site,
in each school district.

44. The board of school commissioners may receive donations
of such sites or locations for school houses as may be designated,
if any be offered; or may purchase the same. Any house al-
ready built and adapted to school purposes, which may be suit-
ably located in any school district, but in no case shall any site
be occupied or any school house be built thereon until a good
and sufficient title shall have been obtained for the same in the
corporate name of the board of school commissioners for the
county.

45. Where lands shall be required for the site of a school
house, or for enlarging a school house lot, and the commissioner
of the district shall, from any cause, be unable to contract with
the owner thereof, the board of school commissioners may apply
for a writ of ad quod damnum to the clerk of the Circuit Court
for the county or the Superior Court for Baltimore city, as the
case may be, who shall forthwith issue the same, and the sheriff
shall execute the said writ and return an inquisition describing
the land and stating the amount of damages to be paid to the
owner, and the judge for the Circuit Court for the county, or of
