36 FEES OF OFFICERS—FISH AND FISHERIES. [ART. 38-41.

or before any justice of the peace, where any white person is
concerned, either as plaintiff or defendant; but any negro or
mulatto, whether slave or free, may be a witness for or against
any negro or mulatto, slave or free, in any proceeding whatever.

Passed March 2, 1864.

ARTICLE XXXVIII.

Fees of Officers.

NOTARIES PUBLIC.

Chapter 137 amends and re-enacts section 25, as follows, (I. Supplement, 44: )

SEC. 1. The three last preceding sections shall not apply to
Notaries in any of the counties, unless the fees on protests in
any one year shall exceed the sum of three hundred dollars, nor
to Notaries in the city of Baltimore unless the fees on protests
in any one year shall exceed the sum of five hundred dollars;
and whenever the fees as aforesaid shall exceed in any of the
counties the sum of three hundred dollars, or shall exceed in
the city of Baltimore the sum of five hundred dollars, one half
of the surplus shall be paid to the Treasurer of the State.

In force from February 19, 1864.

ARTICLE XLI.

fish and fisheries.

Chapter 71 adds the following sections to this Article, under the sub-tide of

WATERS OF THE POTOMAC RIVER, LYING BETWEEN THE MOUTH
OF NEW CREEK AND WEAVERTON DAM.

SEC. 1. It shall not be lawful for any person or persons to
whip or beat the water in that part of the Potomac river lying
between the mouth of New creek and Weaverton dam, with
poles, sticks or other things, for the purpose of driving the fish
