PRIVATE ACTS—CHARTERS. 11

SEC. 6. And be it enacted, That so much of section fifteen in the said
original act, as provides for the filling of vacancies, be and the same is
hereby repealed, and that should a vacancy hereafter occur by death,
resignation or disqualification, the Board of Directors are hereby
authorized and empowered to fill such vacancy, until the next regular
election.

SEC. 7. And be it enacted, That this act shall take effect, when the
same be accepted by a majority in interest, of the stockholders of said
company, represented in person or by proxy, at a meeting to take place
on notice given by the President and Directors, for two weeks at least,
in two or more daily newspapers of the city of Baltimore, stating the
object of the meeting to be the consideration of the question of accept-
ing this act, and if accepted as aforesaid, to take effect immediately
thereafter.

BALTIMORE CITY PASSENGER RAILWAY COMPANY.

AN ACT entitled An Act to Incorporate the Baltimore City Passenger Railway

Company.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Henry Tyson, John W. Walker, William Chesnut, John W. Ran-
dolph, Conrad S Grove, Jonathan Brock and Albert W. Markley, and
others, their associates, assignees of all the rights, powers and privileges
granted to William H, Travers, William S Browning, William D'Goey,
Robert Cathcart and Joshua B. Sumwalt, and their associates and as-
signs, by an ordinance of the Mayor and City Council of Baltimore, ap-
proved on or about the twenty-eighth of March, eighteen hundred and
fifty-nine, be and they are hereby incorporated by the name and style of
the Baltimore City Passenger Railway Company, and by that name
shall have perpetual succession, and be capable to sue and be sued, to
make and use a common seal, to make and pass by-laws, to acquire and
hold all necessary real estate, and in general to have and exercise all
such other corporate powers and faculties as may be necessary and pro-
per to effectuate the purpose of this act.

SEC 2. And be it enacted, That the corporation by this act created
be and the same is hereby vested with all the rights, powers and privi-
leges given and granted by the ordinance before mentioned, to be by the
said corporation held, enjoyed and exercised in manner and form, and
upon the terms and conditions, and subject to the restrictions and limi-
tations therein contained, except where the provisions of said ordinance
may be inconsistent with this act or any part thereof; and upon the ac-
ceptance of this act by the said Henry Tyson, John W. Walker, William
Chesnut, John W. Randolph, Conrad S. Grove, Jonathan Brock and
Albert W. Markley, and others, their associates, all railways, railway
cars, horses, and other property of every description, real, personal and
mixed, acquired and held by them for the purposes mentioned in, and
