ART. 15. ] MONTGOMERY COUNTY. 91
ORPHANS' COURT.

The Act of June 10, 1861, ch. 60, adds the following section:

9. Each judge of the Orphan's Court for said county shall be
entitled to three dollars a day for each day he shall attend to the
duties of his office, and five cents for every mile he shall neces-
sarily travel from his place of residence to their place of meet-
ing, but no mileage in returning.

RETAILERS.

The Act of 1862, ch. 242; adds the following, Amendatory of section 48:

10. The clerk of the Circuit Court for Montgomery county
shall not grant a license to any person to sell intoxicating drinks,
at any time, within two miles of the village of Brookville in said
county, nor shall said clerk grant such license within the limits
of the first election district in said county, nor within a radius
of four miles from Emory chapel and. school in said county, nor
shall the said clerk grant such license to any person within
either of said limits, without, in either case, an order in writing
from the judge of the said Circuit Court, and the said judge may
grant such order, if satisfied from representations, in writing, of
respectable inhabitants of said neighborhood or village, as the
ease may be, of the propriety and necessity of granting the same

The Act of 1862, ch. 136, adds the following, Amendatory of same section:

11. It shall not be lawful for the clerk of the Circuit Court of
Montgomery county, to issue a license to any person to sell
ardent spirits at any place within two and half miles of Sandy
Spring meeting house, without an order in writing from the
judge of the said Circuit Court; and the said judge may grant
such order if satisfied from representation in writing of respec-
table inhabitants of said neighborhood or village as the case
may be of the necessity and propriety of granting the same
