after be received from the said mayor and city council by the-
said owner.
41. The said park commissioners, are authorized to enlarge
the streets and avenues around and leading to the said park;
and in the event of failing to agree with the owner of any pro-
perty required for that purpose, or of any interest therein, for
the purchase thereof, or if the owner be a feme covert, under
age, non compos mentis, or be residing out of the county at the
time, the said commissioners are hereby authorized to condemn,
the same, in the manner specified in the foregoing section, the
oath to each juror being, that he will justly and impartially
value the damages which the owner will sustain by the enlarg-
ing of the particular street or avenue, as the case may be, and
the jury, in. estimating such damages, shall not make any allow-
ance or deduction on account "of any real or supposed benefits
which the owner may derive from paid park, or from, such en-
largement of said street or avenue..
POLICE.
The Act of 1862, ch. 1-31, repeals sections 806, 807, 809, 810, 811, 815, 821, and
substitutes the following:
42. There is hereby established, within and for the city of
Baltimore, a Board of Police, to be called the Board of Police of
the city of Baltimore, to consist of two commissioners, as is here-
inafter provided, together with the mayor of said city, for the
time being, or whosoever may be lawfully acting in that capa-
city; the said commissioners shall be citizens of the United States,
and shall have been residents of said city for the period of twelve
months next preceding their appointments; they shall, except as-
hereinafter specified, hold their offices for four years, and until
their respective successors shall have been appointed and quali-
fied, and shall receive each a salary of two thousand dollars per
annum, payable quarterly; before entering on the duties of their
said office, the said commissioners and the said mayor, shall take
and subscribe before the judge of the Superior Court of Balti-
more city, or the clerk thereof, the oath or affirmation prescribed
