3586 ARTICLE 99

The term "closed season" shall mean the time during which game or
fur-bearing animals may not be legally taken or killed and includes all
periods of time not included within the open season.

The term "hunt" shall mean to include: hunt, pursue, catch, kill, trap,
shoot or attempt to hunt, pursue, catch, kill, trap or shoot.

Game and Inland Fish Commission.

3. A Commission to be known as the Maryland State Game and Inland
Fish Commission is hereby created. The Commission shall consist of five
citizens of this State, who shall be appointed by the Governor and who
shall fairly represent the several geographical sections of the State, and no
person shall be appointed to said Commission unless said person has held
or has been the owner of a hunter's license or an angler's license prior to
said appointment; and said person shall be well informed on the subject
of wild life conservation and restoration, especially wild water-fowl, birds,
game, fur-bearing animals and inland fishes.

The members of the Commission shall hold office for terms of five (5)
years and shall receive no compensation for their services as members
thereof, except that each Commissioner shall be reimbursed for actual and
necessary traveling expenses incurred or made by him in the discharge
of his official duties to be paid from the State Game Protection Fund at
the rate of five cents (5c) per mile for traveling expenses and not more
than five dollars ($5.00) per day for subsistence.

The Governor of Maryland shall designate one Commissioner to serve
for one year; one Commissioner to serve for two years; one Commissioner
to serve for three years; one Commissioner to serve for four years; and
one Commissioner to serve for five years; all of said terms shall begin on
the first Monday in June, 1939. Thereafter such appointments of Com-
missioners shall be for terms of five (5) years.

Upon the death, resignation or removal from office of any person so
appointed as aforesaid, the Governor shall fill the vacancy for the unex-
pired term. The Governor may remove a Commissioner for inefficiency,
neglect of duty, or misconduct in office.

The Commission shall hold meetings at the office of the Commission in
July and January and at such other times and places within the State as
the Game Warden may appoint. At the meeting held in July, the Com-
mission shall elect one of its members as chairman, and one of its mem-
bers as vice-chairman. Such officers shall hold office for a period of one year.
Three members of the Commission shall constitute a quorum for the trans-
action of business.

4. The Game and Inland Fish Commission of Maryland shall appoint,
in accordance with the provisions of Article 64A of the Annotated Code of
Maryland, a Game Warden for the State, who shall receive such salary
as shall be provided in the budget, and he shall be entitled to traveling
expenses, and all other expenses incurred in the discharge of his duties;
provided, however, that the present State Game Warden shall be the first
Game Warden of this State under the provisions of this section, and pro-
vided further, that the present Game Warden, all officers and employees
of the Game Division of the Conservation Department of Maryland, and
