1939, ch. 752, sec. 1.
1. (General Provisions.) Only qualified persons to hold themselves
out as professional engineers and land surveyors. It is hereby declared
that in order to safeguard life, health and. property and to promote the
public welfare by requiring that only properly qualified persons shall hold
themselves out as professional engineers or land surveyors or use the
designation of professional engineer or land surveyor in the State of Mary-
land, such persons shall be compelled to submit evidence that they are
qualified to practice professional engineering or land surveying, and shall
be registered as hereinafter provided.

2. (Definition—Engineer.) The term engineer as used in this Article
shall mean a professional engineer as hereinafter defined.
(Definition—Professional Engineer.) The term professional engineer
as used in this Article shall mean a person who is qualified by reason of
his knowledge of mathematics, the physical sciences, and the principles
of engineering, acquired by professional education and practical experi-
ence, to engage in the practice of professional engineering as hereinafter
defined.
(Definition—Engineering.) The term engineering as used in this Arti-
cle shall mean professional engineering as hereinafter defined.
(Definition—Professional Engineering.) The practice of professional
engineering within the meaning and interest of this Article includes any
professional service, such as consultation, engineering investigation, evalua-
tion, planning, design, or responsible supervision of construction or opera-
tion, in connection with any public or private utilities, structures, build-
ings, machines, equipment, processes, works, or projects, wherein the pub-
lic welfare or the safeguarding of life, health or property is concerned or
involved, when such professional service requires the application of en-
gineering principles and data.
(Definition—Article Inapplicable To Certain Operators, Etc.) The
practice of professional engineering shall not include the work ordinarily
performed by persons who operate or maintain machinery, or equipment.
