to do to the. official in charge of the nearest police boat, in which notice he
shall name the week day or week days and the hours between sunrise and
sunset of such week day or week days in such closed season during which
he' may intend to take oysters from such land, and it shall be unlawful for
the holder of any such land to take up oysters from the land held by him
at any other, times than those named in such notice. Any person violating
any of the provisions of this section shall be deemed guilty of a misde-
meanor, and upon indictment and conviction in any Circuit Court for
any county of this State, or in the Criminal Court of Baltimore City, be-
fore which such case is tried, shall be subject to all the penalties provided
in Section 28 of this article for taking oysters unlawfully within the pro-
visions of certain sections therein referred to. Provided, however, that
nothing in this section shall apply to Dorchester, Anne Arundel, .Talbot,
Charles, Wicomico, Kent and Queen Anne's Counties.

128. Any person who shall dredge or otherwise take oysters from any
of the natural beds or bars in the waters of this State, or neutral zones
surrounding them, in violation of any of the laws of this State, shall be
deemed guilty of a misdemeanor, and upon indictment and conviction
in any Circuit Court for any County of this State, or in the Criminal
Court of Baltimore City, before which such case is tried, shall be subject
to all the penalties provided in Section 28 of this Article, for taking oys-
ters unlawfully within the provisions of certain Sections therein referred
to, and the Board of Public Works is hereby authorized to purchase and
maintain motor or other boats that may be required by the State Fishery
Force to enforce the provisions of this Section, and to pay for the same
out of the revenues received under this sub-title.

129. Any person who shall wilfully and without authority take or
remove oysters from any land leased tinder the provisions of this sub-title,
or shall wilfully injure or interfere with the oysters of such land in any
manner, or injure the oysters thereupon situated, or remove, alter or in-
terfere with the stakes, buoys or monuments marking the same, shall, upon
conviction thereof, for the first offense, be sentenced to imprisonment in
jail or in the penitentiary, in the discretion of the court, for not less than
three months and not more than two years, and for the second, or any sub-
sequent offense, be sentenced to imprisonment in the penitentiary for not
less than two years and not more than five years.

130. Any person who shall work a dredge, scrape or pair of tongs, or
any other implement for the taking of oysters upon any land leased under
the provisions of this sub-title, without the consent of the lessee or owner,
or who shall, while upon or sailing over any such ground or bed, cast, haul,
or have overboard any such dredge, scrape or pair of tongs or other imple-
ment for the taking of oysters, under any pretense, or for any purpose
whatever, without the consent of such lessee or owner, upon conviction
thereof, shall, for the first offense, be fined not less than fifty dollars, nor
more than two hundred and fifty dollars, or, in the discretion of the court,
be imprisoned in jail or in the penitentiary for not less than three months.
