77. It shall be unlawful for any person to carry or attempt to carry
or buy for the purpose of carrying out of the State any oysters taken from
the natural rocks, beds or bars in the waters of this State, until he has
first obtained for each cargo a permit to do so from the Deputy Com-
mander or Inspector from whose district said cargo is to be taken, and
has paid to the Deputy Commander or Inspector an inspection tax of four
cents per bushel on the number of bushels in said cargo in order to defray
the cost of such inspection; said inspection tax on oysters shall attach
irrespective of actual sale of oysters and shall be effective prior to shuck-
ing or shipping same.
Any person violating the provisions of this section shall upon conviction
be fined the sum of not less than one hundred dollars nor more than two
hundred dollars and the boat or vessel, together with her tackle used in
the violation shall be forfeited to the State to be dealt with in accordance
with Section 32; and all oysters found on said vessel shall be returned to
the beds whence taken.
All taxes collected under the provisions of this Section shall be remitted
to the Conservation Department and forwarded to the Comptroller or State
Treasurer to be placed to the credit of the Conservation Fund.
Nothing in this Section shall be construed to permit or allow the catch-
ing or removing of oysters measuring less than three inches from hinge to
mouth.1

78. All Acts or parts of Acts inconsistent herewith are hereby re-
pealed. In case any section or provision of sections 75 and 76 shall be
held unconstitutional or invalid, the same shall not be held to affect any
other provision of said sections.

79. At the beginning of each oyster season the Conservation Commis-
sion shall divide the inspection points in Baltimore City into four inspec-
tion districts and organize the board of inspectors provided for the City
of Baltimore in section 74 of this article, and all general measurers and
inspectors provided in said section 74 shall be assigned to and remain
during the whole season at the specific points to which they are assigned,
subject, however, to the discretion of the Commission; and the Commis-
sion shall have general control and supervision over all general measurers
and inspectors and special inspectors; and the said general measurers
and inspectors and special inspectors are hereby required to report to the
Commission whenever required, and if they shall refuse or neglect to
make such report they shall be fined for each said failure or refusal the
sum of ten dollars, to be deducted from their salaries, and the said Com-
mission shall have the power to transfer any general measurer and in-
spector or any special inspector from any house or district whenever it
may deem it best for the good of the service to. enforce the proper inspec-
tion, the cull law and the collection of the tax for the oyster fund. In
addition to the certificates required by Sections 75 and 76 hereof, every
