(3A) (Danger and Caution Signals.) Every motor bus and every motor
omnibus for the carriage of passengers for hire, except taxicabs, and every
commercial motor vehicle having a carrying capacity of two tons or over,
shall be equipped with at least two red or yellow burning danger or caution
signals, with friction cap ignition, similar in type to a time-burning rail-
way fuse signal, and so constructed as to burn with a brilliant red or
yellow light for not less than fifteen minutes.

Whenever any such vehicle becomes disabled while within the limits
of the traveled part of a highway to such an extent that it cannot proceed
under its own power, and its lighting is so disabled that it constitutes a
menace to other vehicular traffic, the operator thereof shall cause to be
continuously dtfplayed on the surface of the highway the red or yellow
burning danger or caution signals, as herein required, in such manner as
to prevent personal injuries, loss of life, and damage to property by col-
lision.

Any person violating any of the provisions of this Section shall be
deemed guilty of a misdemeanor and upon conviction shall be subject to
a fine of not less than five nor more than fifty dollars, and in default of
payment thereof shall be liable to imprisonment for not less than ten nor
more than thirty days in the discretion of the Justice of the Peace or the
Court hearing such case.

(4) (Mufflers.) No driver or operator of any motor car, taxicab, auto-
mobile, motor truck or motorcycle shall use any cutout, fitting or other
apparatus or device which will allow the gases from the engine of the motor
vehicle to escape into the atmosphere without first passing through a
silencer, expansion chamber or other contrivance suitable and sufficient for
reducing as far as may be reasonably practicable the noise which would
otherwise be caused by the escape of the said gases; provided that this
regulation shall apply to a motor vehicle propelled by an internal combus-
tion engine.

(4A) (Emblems.) It shall be unlawful for any person to display upon
a motor vehicle the insignia or emblem of any motor vehicle club or similar
organization, unless he shall be entitled to use the same under the constitu-
tion, by-laws, rules or regulations of such club or organization.

(4B) (Smoke Screen.) No motor vehicle of any kind shall at any time,
whether in use or not in use, carry or be equipped with any device, de-
signed, constructed or intended to be used for the purpose of emitting or
laying down a smoke screen or emitting or discharging any screen of vapors,
gases, fumes or substances of any kind, and it shall be unlawful for any
such device, or part of such device, whether in operating condition or not,
to be attached to any motor vehicle. Any person violating any of the pro-
visions of this sub-section shall be guilty of a felony and, upon conviction
thereof, shall be punished by imprisonment in the House of Correction
for a term of not less than one year nor more than five years in the discre-
tion of the Court.

(5) (Penalties.) Any person violating any of the provisions of this
section shall be deemed guilty of a misdemeanor, and except in other cases
in this section otherwise provided for, upon conviction, subject to a fine
of not less than five dollars ($5.00) nor more than fifty dollars ($50.00),
for the first offense; provided, however, that in the event approved lenses
or bulbs are used, and, due to improper adjustment, they do not comply
with all the provisions of this section, no penalty shall be imposed for the
first offense.
