business transacted, together with the certified tester or the person weighing
and sampling, either or all, to be held equally responsible.

509. Any person or persons violating any of the provisions of this sub-
title except Section 498 shall be guilty of a misdemeanor and upon convic-
tion thereof shall be sentenced to pay a fine of not less than ten dollars
($10.00) or more than fifty dollars ($50.00), or imprisonment in the
county jail for not less than ten days or more than thirty days, or both, at
the discretion of the court for the first violation, and not less than fifty
dollars ($50.00) or imprisonment in the county jail for not less than thirty
days, or both, at the discretion of the court for each subsequent violation.
Any person or persons found guilty of violation of Section 498 of this sub-
title shall be guilty of a misdemeanor and upon conviction thereof shall
be sentenced to pay a fine of not less than one hundred dollars ($100.00)
or more than one thousand dollars ($1,000.00) or imprisonment in the
county jail for not more than nine months for the first violation, and not
less than one thousand dollars ($1,000.00) or imprisonment in the county
jail for not less than nine months, or both, at the discretion of the court for
each subsequent violation.
All fines and penalties imposed and received for the violation of any of
the provisions of this sub-title shall be paid to the University of Maryland
College of Agriculture or its agents and all monies so collected shall be used
to meet the expenses of the University of Maryland College of Agriculture
in the enforcement of this sub-title until September 30, 1937. Thereafter
all fees received under this sub-title shall be paid into the State Treasury
to be used solely in enforcing the provisions of this sub-title and shall be
included in the State Budget to be submitted to the General Assembly at
each regular session.

510. If any provision of this sub-title is declared unconstitutional or
the applicability thereof to any person or circumstance is held invalid, the
constitutionality of the remainder of the sub-title and the applicability
thereof to other persons and circumstances shall not be affected thereby.1
