39. The local legislative body of a city, village, or town, and the Board
of County Commissioners of any county which has established an airport
or landing field and acquired, leased, or set apart real property for such
purposes may construct, improve, equip, maintain, and operate the same,
or may vest jurisdiction for the construction, improvement, maintenance,
and operation thereof, in any suitable officer, board, or body of such city,
village, town, or county, or may lease the same to any person or corpora-
tion on such terms and conditions as it may deem proper. The expenses
of such construction, improvement, equipment, maintenance, and operation
shall be a city, village, town, or county charge as the case may be. The
local legislative body of a city, village, or town, and the County Commis-
sioners of any county may adopt regulations and establish fees or charges
for the use of such airports, or landing field, or may authorize an officer,
board, or body of such village, city, town, or county having jurisdiction to
adopt such regulations, and establish such fees or charges, subject, how-
ever, to the approval of such local legislative body before they shall take
effect.

40. The local authorities of a city, village, town or county to which this
sub-title is applicable having power to appropriate money therein may
annually appropriate and cause to be raised by taxation in such city,
village, town, or county, a sum sufficient to carry out the provisions of this
sub-title.

41 The powers conferred upon local legislative bodies and County
Commissioners by Sections 35 to 40, inclusive, shall include acquisition
of property for an airport to be maintained by any common carrier or car-
riers of passengers or freight by air; and when any such local legislative
body or Board of County Commissioners has contracted with any such
common carrier to acquire any such airport and sell the same to such
common carrier, it may borrow not exceeding the amount of the purchase
price under said contract and use said moneys for acquisition of said
property by purchase, condemnation or otherwise.

42. The State Aviation Commission is hereby authorized to promul-
gate plans, ratings and regulations relating to the construction and main-
tenance of airports or landing fields used for public purposes in this State,
which plan's, ratings and regulations shall conform to and coincide with,
so far as possible, the plans, ratings and regulations, issued from time to
time by the Department of Commerce, pursuant to the provisions of the
United States Air Commerce Act of 1926, and amendments thereto. It
shall be unlawful for any person or corporation to operate aircraft regu-
larly for the purpose of carrying passengers for hire from any airport or
