1929, ch. 180, sec. 4.

78. Any person convicted before any Justice of the Peace of this State
for violation of any of the provisions of this sub-title shall be deemed guilty
of a misdemeanor, and shall be fined not less than $25.00 nor more than
$200.00 and costs for each and every offense in addition to the forfeitures
provided for elsewhere in Article 39. The fines and forfeitures recovered
for violation of this sub-title shall be paid over to the State Comptroller
and credited to the Conservation Fund.

79. If any clause, sentence, paragraph or section of this sub-title
shall, for any reason, be adjudged by any Court of competent jurisdiction
to be unconstitutional and invalid, such judgment shall not affect, impair
or invalidate the remainder thereof, but shall be confined in its operation
to the clause, sentence, paragraph or section thereof so found unconstitu-
tional and invalid.1

PART 3.
Non-Tidal Waters.

80. (Seasons.) No person shall fish for or catch any game or fresh
water fish, as defined in Section 1 of this Article, except at such times
as provided for in this Section.

The open fishing season in the waters of this State, above- a point where
the tide ebbs and flows, including ponds, lakes, canals, and the Conowingo
Pool, for the catching of fish 'designated in this section, shall be as fol-
lows, viz:

Trout (Brook, Brown and Rainbow)—April 1st to June 30th, except
in the Youghiogheny River below Swallow Falls in Garrett County, the
open season on Rainbow trout shall be July 1st to November 30th; pro-
vided, however, that it shall be unlawful for any person to fish for or catch
any fish in any of the waters or streams which have been stocked with
trout by the State between the hours of 8.00 P. M. and 5.30 A. M.

Bass (Large and Small Mouth)—July 1st to November 30th.

Rock or Striped Bass—June 1st to November 30th.

Susquehanna Salmon—June 1st to November 30th.

Suckers, Catfish, Carp, Eels and Gudgeon—February 1st to November
30th.

Shad, Hickory Shad and Herring—March 15 to June 20th; provided,
however, that they can be caught only with rod, hook and line, using bait
or lure and cannot be taken in any other manner, nor in any place other
than between Hog Back Shoals and the Conowingo Dam.

All other species of game or fresh water fish, July 1st to November 30th.

All dates mentioned above are inclusive.

The open season on fishing in Deep Creek Lake shall be as provided in
Section 94 of this Article.

81. (Further Restrictions on Fishing in Non-Tidal Waters.) It shall
be unlawful to catch or attempt to catch any game or fresh water fish, as
