1364 ARTICLE 31

1933 (Special Sess.), ch. 30, sec. 11 A. 1935, ch. 40.

21. None of the provisions of this sub-title shall apply to Somerset,
Garrett, Caroline, Carroll and Frederick Counties, and that the County
Commissioners of said Counties and municipal corporations located therein
shall have none of the powers provided for in this sub-title, except that
in the town of Crisfield, Somerset County, the corporation officials shall
have the power to borrow under the provisions of this sub-title any sum
not in excess of thirty-five thousand dollars ($35,000.00). None of the
provisions of this sub-title shall apply to any incorporated town in Talbot
County and said incorporated towns located therein shall have none of
the powers provided for in this sub-title.

22. If any one or more sections, clauses, sentences, or parts of this
sub-title shall for any reason be questioned in any court, and shall be
adjudged unconstitutional or invalid, such judgment shall not affect,
impair or invalidate the remaining provisions thereof but shall be con-
fined to its operation to the specific provisions so held unconstitutional or
invalid, and the inapplicability or invalidity of any section, clause or pro-
vision of this sub-title in any one or more instances shall not be taken to
affect or prejudice in any way its applicability or validity in any other
instance.

23. This sub-title may be known and cited as "The Public Works Act."

24. In so far as the provisions of this sub-title are inconsistent with the
provisions of any other law, the provisions of this sub-title shall be
controlling.

25. Any municipality as defined by this sub-title shall have the power
and is hereby authorized to contract debts or to borrow money and to issue
and sell its negotiable bonds therefor in order to provide funds for any
public works project, as defined in paragraph (e) of Section 10 of this
sub-title in connection with any Act of the Congress of the United States
of America, which provides assistance in the construction of such public
works whether such assistance consist of making a grant of money to
said municipality, a loan thereto, or some other method of financing the
construction of the public works contemplated.

26. The following terms, wherever used or referred to in this Act, shall
have the following meaning:

(a) The term "public body" means any county, city, town, special dis-
trict, or any municipal or public corporation, or political sub-division or

visions of Sections 10 to 25 inclusive of this Article, so as to empower all municipalities
of this State, as defined in said Section 10, to meet the current emergency by con-
tinuing the financing and construction of public works in the manner and subject to
the limitations prescribed by said sections of said Article above referred to, up to and
including June 1, 1941.
