COUNTY COMMISSIONERS 1021

59. Any person assessed for a tax may discharge the same by work and
labor, to the amount of his proportion of assessment for cutting said ditch,
exclusive of his proportion necessary to pay damages and other expenses;
and the managers' certificate for work done shall be received by the trea-
surer in payment of the tax.

60. The treasurer shall give bond in the name of the State of Maryland
as obligee, to be approved by the managers, in double the amount of the
assessments or taxes he may be authorized to collect and receive, conditioned
for the faithful performance of his trust and duty and the payment of any
money, and 1 all books, accounts and papers in his possession belonging to
the ditch company in his hands as treasurer over to his successor at the
expiration of his term; and such bond may be sued on by any person in-
terested as public bonds may.

61. He shall collect all monies levied for the purpose of cutting, making
and opening or for cleaning and repairing the ditch or ditches, or for
payment of damages and expenses; and, in case of refusal or neglect of any
person bound to pay the same, shall proceed to collect and recover them in
the manner that county rates or levies are recoverable by law.

62. He shall settle with the taxables at their annual meeting in March
for all sums collected by him, and shall be entitled to retain five per centum
of his receipts as a compensation for his services.

63. In case of the death, resignation or removal out of the county, or
other disqualification of either or both of said managers, or of the treasurer,
any three of the taxables rated for such ditch or ditches may immediately
call together, by advertisement, as hereinbefore directed, the taxables rated
for such ditch or ditches, for the purpose of supplying such vacancy; and
the person or persons receiving a majority of votes cast at such meeting
shall be declared duly elected to serve until the annual election.

64. Any person taxed for any ditch which does not pass through or
upon his land may open a ditch or ditches through the intervening lands
into such main ditch or ditches and keep the same open at his own cost
and charge; provided that no such cross-ditch shall be cut through the
land of any other person without the consent of the owner of such land,
unless the same be laid out and approved, and the damages thereon accruing
to the owner of the land be assessed by the commissioners appointed to lay
out the main ditch, or by three other freeholders appointed by the county
commissioners for said county for the purpose of assessing such damages.
