of each class of members shall be equal. Producers so appointed may or
may not be duly authorized officers of any one or more cooperative milk
association, and distributors may or may not be members of any organiza-
tion of distributors. The members of any such advisory board shall serve
without compensation. Any such advisory board or any such advisory
boards acting in conjunction in any marketing area may submit to the
Commission recommendations with respect to rules and regulations to be
adopted by the Commission, or to be adopted with its approval by any
such association of producers, or of distributors, or of both. The Commis-
sion may adopt or approve any such rules or regulations which may be
designed to accomplish the purposes of this Article.
(g) To adopt and enforce all rules, regulations and orders necessary
to carry out the provisions of this Article, including rules and regula-
tions establishing minimum prices to be paid by milk dealers to producers
and others, and to be charged by producers and others to milk dealers
for milk in its various grades and uses governing the method of deter-
mining the proportion of the lacteal secretion of the entire herd of a
producer which shall be accepted and paid for pursuant to such price or
prices as may be established by the Commission under authority of this
Article, and such price shall be f. o. b. distributive plant in the respec-
tive sales area; provided that the Commission shall have power to estab-
lish equitable deductions for milk received by distributors at receiving-
stations, establishing minimum wholesale or retail prices to be charged
by milk dealers for milk handled within the State for fluid consumption
wheresoever produced or establishing other reasonable trade practices and
prices affecting the relations between the producers and distributors in
any market or affecting the marketing of milk at wholesale or retail in
any market. Every rule, regulation or order of the Commission shall be
continuously posted for public inspection in the principal office of the
Commission for at least five days prior to its effective date, and copies
shall be mailed to all dealers affected thereby; provided, however, that in
an emergency in the determination of the Commission, the five days post-
ing may be waived. An order applying only to a person or persons named
therein shall be served on the person or persons affected by personal de-
livery of a certified copy, or by mailing such certified copy to each person
affected thereby, or in the case of a corporation to any officer or agent
thereof upon whom a summons may be served in a civil action. The post-
ing required by this section shall constitute due and sufficient notice to all
persons affected by any such rule, regulation or order which is not hereby
required to be served.
(h) To require the butter fat content of milk and cream received by
the distributors from producers to be determined by independent labora-
tories or qualified persons approved by the Commission and copies of the
tests made shall be filed with the Commission, the payers of the costs
thereof to be determined by the Commission.
