"Distributor" includes all persons who purchase, or handle milk within
this State for sale, shipment, storage, processing, or manufacture into
dairy products within or without the State other than solely for manu-
facture into butter or cheese. Said term, however, excludes all persons so
purchasing, or handling milk for the purpose only of sale by such persons,
in one or more retail stores, or in one or more places where such milk is,
sold to customers for consumption on the premises if such persons do not.
pasteurize, standardize, or otherwise process such milk, and excludes all
persons hereinafter included under the term "distributing broker".
"Producer-distributor" includes all persons owning, managing or con-
trolling a dairy herd or herds who put the milk produced therefrom in
bottles or other containers in which the same is designed to be sold, or
cool, pasteurize, standardize, or otherwise process such milk or manufac-
ture it into any dairy product other than solely for manufacture into
butter and cheese for the purpose of distributing the same at wholesale
or retail, or who distribute such milk at wholesale or retail.
"Producer" includes all persons owning, managing, or controlling a
dairy herd or herds, excepting those hereinbefore defined as "producer-
distributors. "
"Distributing broker" includes all persons who on their own account
accept or receive milk from a distributor or producer-distributor for sale,
or distribution at wholesale or retail.
"Delivery vehicle" includes all vehicles used for making delivery of
milk either at wholesale or retail.
"Retail store" includes all places where milk is sold for consumption,
off the premises.

2. The Maryland Milk Control Commission is hereby created, to con-
sist of three members not more than two of whom to be of the same
political party, to be appointed by the Governor from a list of twelve
names submitted by the State Board of Agriculture, not more than six
of those submitted to be of the same political party. The members of the
Commission so appointed shall serve until June 1, 1937, without sooner
removed as hereinafter provided. Vacancies in the membership of said
Commission shall be filled in the same manner from four names for each
vacancy submitted by said Board; provided that at no time shall more
than two members of the Commission be of the same political party.
Any member of said Commission may be removed by the joint action of
the Governor and said Board for malfeasance, misfeasance, or nonfeas-
ance in office. The compensation of the members of the Commission so
appointed shall be fixed by the State Board of Agriculture. The Com-
mission shall have power to rent offices, employ an executive secretary.
and such other employees and attorneys as shall be necessary to properly
administer this Article, and fix the compensation of such employees; pro--
vided, however, that the entire expense in connection with the administra-
tion of this Article shall not exceed the amount realized from the tax:
imposed under the provisions thereof.
