pounds purchased for the person, firm or corporation for its own account,
together with the average price received by such person, firm, corporation
or agency upon total of all sales; the Maryland State Board of Agricul-
ture shall so prepare the form of the account or report to be made by the
said persons, firms or corporations engaged in the sale of leaf tobacco
through the Baltimore market that when the same are returned to it as
hereinbefore required, the said account or report shall contain the infor-
mation hereinbefore specified, and it shall be the duty of said persons,
firms and corporations engaged in the sale of leaf tobacco on or through
the Baltimore market as aforesaid to fully and correctly give the informa-
tion called for by the said the Maryland State Board of Agriculture, in
said form of account or report; provided, however, that this and Sections
53 and 54 of this Article shall not apply to any person, firm or corpora-
tion engaged solely in the buying of leaf tobacco, either for his, their or
its own account, or for resale or for the account of a principal.

52A. If any person, firm or corporation or other sales agency engaged
in the business of selling Maryland grown leaf tobacco on commission as
agent for the grower or shipper, shall resell any such tobacco in the name of
the original grower or shipper and not in the name of the true owner, the
said person, firm, corporation or sales agency so reselling shall make a
report of such resale to the executive officer of the Maryland State Board of
Agriculture on or before the 5th day of the ensuing month, showing the
person or corporation to whom or to which sold, name of shipper or person
in whose name it was sold, the warehouse hogshead number, and if the
hogshead has been resampled, the previous warehouse number or numbers,
and the date of sale of each hogshead, the weight, and at what price per
pound sold, and such report when received by the State Board of Agricul-
ture shall be a public record subject to inspection. Any person, firm or
corporation or sales agency failing to make such report shall be deemed
guilty of a misdemeanor and, upon conviction thereof, be fined not less
than twenty-five dollars nor more than two hundred dollars.

55A. Any person, firm, association or corporation which sell hogsheads
of tobacco directly for the growers, shall first give a bond to the State of
Maryland for a penalty in the amount of twenty-five thousand dollars
($25, 000), the said bonds to be deposited with the State Comptroller, to
protect said growers from any loss or losses sustained from failure by any
of said persons, firms, associations or corporations. Any person, firm,
association or corporation violating the provisions of this section shall be
guilty of a misdemeanor and upon conviction thereof shall be punished
by a fine of not more than five hundred dollars ($500).
