476 ARTICLE 39.

unless he shall first take out a license as hereinafter provided, shall haul for
or catch fish with any seine, or set net of any description, in the waters of
Sinepuxent Bay or its tributaries within said county; and no person shall
fish in the waters of Sinepuxent Bay or its tributaries within the limits
of Worcester County with any seine or net of any description containing
meshes less than one and one-half inches square, except only during the
months of July, August, September and October, when this section shall
not apply to fishing for fat backs and crocus.

(d) The Clerk of the Court is authorized upon the payment to him of
the fee of $100. 00, and upon application by a non-resident of the county
not being a taxpayer, as provided for above, to issue a license to such ap-
plicant authorizing him to fish for one year with seines and nets in the
waters of Sinnepuxent Bay and its tributaries within said county as a
resident of the county is permitted to do.

(e) It shall be unlawful for any person to fish at any time except by
Tod, hook and line in that part of the waters of Hering Creek which lie
south of the dam, now partially constructed and intended to be completed,
find which dam is contiguous to and south of the state road bridge crossing

Hering Creek.

Nets and Seines.

1929, ch. 471,. sec. 42.

43. Sizes of Mesh. Unless otherwise provided in this Article, it shall
be unlawful after December 31st, 1931, to fish with airy nets mentioned
in any section of this Article whose size of mesh is less than herein pro-
vided: Purse or Buck Nets, 3 inches: Pound Nets, 2 1/4 inches; Haul
Seines, 2 1/2 inches; Gill nets, 2 1/2 inches; Fyke and Hoop Nets, 2 1/4
inches; provided, it shall be lawful to continue the use of such nets, now
owned and lawfully operated under the laws in effect January 1st, 1929,
until the above date, and the present laws regulating the size of mesh
shall continue in force until the 31st of December, 1931. Nothing in the
foregoing provisions of this section limiting the size of mesh shall apply to
the catching of eels.

44. Removal of Stakes and Nets. It shall be unlawful to permit or
allow to remain in the waters any stakes or nets after the close of the fish-
ing season or at other times when this Article prohibits stakes and nets
to be placed, but all nets must be removed at the end of the season and all
stakes must be removed within ten days thereafter.

45. Emptying Seines. It shall be unlawful for any person to empty
his seine upon the shore or beach so as to leave the small fish to perish, or
in any water less than 12 inches deep, but he shall at all times empty
