to the waters lying north of a straight line drawn from Black Walnut Point
to Benoni's Point in Talbot County, nor to the waters of Prospect Bay in
Queen Anne's County.
(a) In said waters mentioned in this Section, it shall be unlawful for
any person to erect, set or maintain a booby, brush or stake blind within
the waters of the Chesapeake Bay opposite the shore line in Anne Arundel
County on the western side of said Bay, at a greater distance than 1, 000
yards from the natural shore line of Anne Arundel County. No person
shall locate another blind within 700 yards of any blind which has been
licensed and located. Said blind shall not be placed in water over eight
feet in depth.
(b) It shall be unlawful for any person to erect, set or maintain a booby,
brush, or stake blind in the waters of Brannock's Bay or Trippe's Bay in
Dorchester County out and beyond a line drawn from Mills Point in a
northeastward direction to the southeast comer of what is known as the
Great Flats, and from thence to what is known as Weir Point or Orchard
Marsh.
(c) It shall be unlawful for any person to erect, set or maintain a booby,
brush or stake blind within the waters of Todd's Bay in Dorchester County,
out and beyond a line drawn three hundred yards northeast of Todd's
Point, thence running south-southeast to a point at the mouth of Chapel
Creek known as Mitchell's Point.
If any clause, sentence, paragraph or section of Sections 38, 40, 41 or
42 shall, for any reason be adjudged by a Court of competent jurisdiction
to be unconstitutional and invalid, such judgment shall not affect, impair
or invalidate the remainder thereof, but shall be confined in its operation
to the clause, sentence, paragraph or section thereof so found unconstitu-
tional and invalid.
(d) It shall be unlawful for any person to erect, set or maintain a booby,
brush or stake blind within the waters of Chesapeake Bay adjacent to Pop-
lar Island and Coaches Neck, and all waters lying north of a straight line
drawn from Black Walnut Point to Benoni's Point in Talbot County, and
within the waters of Prospect Bay in Queen Anne's County, at a greater
distance than 1, 000 yards from the natural shore, said blind not to be
placed in water over eight feet in depth. 1

43. It shall be lawful for any person hunting in a licensed booby, brush
or stake blind to use a skiff or row boat propelled by oars for the purpose of
retrieving wounded or dead water fowl, when same has been wounded or
killed from said blind. Every person erecting a blind or digging a pit on
a field or fields for the purpose of hunting water fowl shall remove said
blind and cover pit in such a manner as to prohibit hunting therefrom
Sec. 2 of ch. 366 of acts of 1929 repealed all laws inconsistent therewith.
