STATE POLICE. 1133

(e) "Motor Vehicle" shall include motor cycle, motor cycle and side
car, and any motor vehicle designed, constructed or intended to be pro-
pelled or drawn by any power other than muscular power, except such
vehicles as run only upon rails or tracks.

(f) "Merit System" shall mean and include Article 64-A of the Code
of Public General Laws of Maryland, 1924 Edition, as said Article has
been amended by any and all subsequent legislation.

(g) "State Employment Commissioner" shall mean the State Employ-
ment Commissioner as set forth in the Merit System.

(h) The singular shall include the plural; the masculine shall include
the feminine and neuter as requisite.

(i) The word "State" as used in this Article shall mean the entire
State of Maryland with the exception of Federal reservation.

(j) For the purpose of promotion, and elevation in rank, before or after
enrollment, as set forth in Paragraphs 9 and 11 of this Article, sergeant
major, first sergeant, detective sergeants, quartermaster sergeant, sergeant
mechanic, and sergeants, shall be of the same rank, and that rank shall be
that of sergeant, and all shall be eligible to take the examination for the
rank of lieutenant as set forth in paragraph 11 of this Article, and all
shall be eligible to be elevated to the rank of Lieutenant as set forth in
paragraph 9 of this Article.

1935, ch. 303, sec. 3.

3. There is hereby created a Department of Maryland State Police.
The head of this Department shall be a Superintendent, with the rank of
Major in the Department. He shall be appointed by the Governor with
the advice and consent of the) Senate. Said Superintendent shall be ap-
pointed for a period of four years, and the term of his office shall run
for a period of four years from the first day of June following his appoint-
ment. Said Superintendent shall be subject to removal by the Governor
for official misconduct or incompetency. Said Superintendent shall hold
his office until his voluntary resignation or removal by the Governor. In
the event the Superintendent is removed or resigns, the Governor shall
have power to appoint a Superintendent in his place and stead, who shall
hold office for the remainder of the unexpired term of the Superintendent
who resigns or shall be removed from office.

4. The Superintendent shall be a citizen of the United States, and a
resident and voter of the State of Maryland. He shall be selected by the
Governor, on a basis of training, experience and qualifications for the
position.

5. The Superintendent may establish and maintain a classification of
ranks and grades for the police employees of the Department as follows:
