department, sub-department, municipal officer, special commission or
board, in addition to compliance with the other provisions of the Charter,
shall be submitted to the Board of Estimates for its approval and shall
be binding upon the city only when so approved.

The litigation in Warren Mfg. Co. v. Balto., 119 Md. 188, gave rise to the enact-
ment of this section.

The Board of Police Commissioners are not subject to the provisions of Section
14 and Section 36C of the City Charter.

36D. The Board of Estimates are hereby authorized to include in the
Ordinance of Estimates, provided for in section 36, such appropriation
as may be necessary to make reasonable provision for employees of the
City who have become, or shall hereafter become, unable to efficiently
perform the duties of their employment through injury received while
in the discharge of their duties in such employment; and also to make
similar provision for persons who have been not less than ten years in
the employment of the City and who have become, or may hereafter be-
come, unable to efficiently perform the duties of their employment through
age or disease. Such provision may take the form of retirement or assign-
ment to lighter duties at reduced pay. Provided that nothing herein
shall apply to any employee whose annual salary exceeds $1,000.00 or
any per diem employee whose annual wages do not exceed $1,000.00 per
annum for eight hours' work per day. The City Council shall have the
same powers with reference to any appropriation authorized by this sec-
tion as they now have under Section 36 with regard to appropriations
therein authorized.*

37. Before any grant shall be made by the Mayor and City Council of
Baltimore, of the franchise or right to use any street, avenue, alley or
highway, or the grant of the franchise or right for the use of any public
property mentioned in Section Y of this Charter, the proposed specific
grant, with the exceptions hereafter in this Section made, shall be em-
bodied in the form of an ordinance, with all the terms and conditions
required by the provisions of this Charter, and such others as may be
right and proper, including a provision as to the rates, fares and charges,
if the grant provides for the charging of rates, fares and charges, and a
provision that the franchise or right shall be executed and enjoyed six
months after the grant. The said ordinance shall, after having been intro-
duced in the City Council, and after the first reading, be referred forth-
with to the Board of Estimates. The said Board shall make diligent
inquiry as to the money value of said franchise or right proposed to be
