854 ARTICLE 4.

estimated, levied, raised or appropriated for the payment of salaries or

compensation of members of the Police Force within said City of Bal-
timore remaining unexpended or unapplied after allowing all claims
payable therefrom, and which accrue during the year 1924 and there-
after, shall revert to the Treasury of the Mayor and City Council of Balti-
more and shall no longer be paid to the special fund as provided by Para-
graphs 5 and 10 of Section 776-C of Article 4 of the Code of Public
Local Laws of Maryland as enacted by Chapter 266 of the Acts of the
General Assembly of 1900, which said Paragraph 5 and Paragraph 10
of Section 776-C are hereby repealed. The Mayor and City Council
of Baltimore and said Board of Estimates shall continue to provide for
any deficiencies in said fund, as provided by Paragraph 11 of Section
776-C of Article 4 of the Code of Public Local Laws of Maryland.

Did not authorize pensions to widows or dependents of employees in case of acci-
dental death in performance of duty.

1929, ch. 113, sec. 20B.

To establish and maintain in connection with the system of pensions
and retirements for the benefit and advantage of the officers, agents, ser-
vants and employees of the Mayor and City Council of Baltimore estab-
lished by Ordinance No. 553 of the Mayor and City Council of Balti-
more, approved February 1st, 1926, or any other system which hereafter
may be established under the authority of the aforegoing paragraph known
as 20A and headed "Pensions," a system of allowances and payments to
be made to the beneficiaries and dependents of such officers, agents, ser-
vants and employees, after the death of such officers, agents, servants and
employees (whether accidental or otherwise and/or whether occurring in
the actual performance of duty, or otherwise); with full power and

authority to the Mayor and City Council of Baltimore to make such
exceptions, conditions, limitations, restrictions and classifications as it
may deem proper and expedient.

This section added us result of decision in Duncan v. Graham, 155 Md. 507.

1929, ch. 113. sec. 2.

That the Mayor and City Council of Baltimore is hereby authorized and
empowered to provide that the said system of allowances and payments
to the beneficiaries and dependents of officers, agents, servants and em-
ployees, in the event of death (whether accidental or otherwise and/or
whether occurring in the actual performance of duty or otherwise) shall
be retroactive to January 1st, 1926, the effective date of said Ordinance
No. 553. approved February 1st, 1926.
