subject was unconstitutional, because it imposed the whole expense of a public
improvement on the individual immediately benefited.

The Mayor and City Council of Baltimore is authorized and empow-
ered to appropriate and pay over such sum or sums, as it shall from time
to time deem proper, for the equipment, maintenance or support of the
Enoch Pratt Free Library of Baltimore City, or of any other free public
library in Baltimore City, or of the branches of the Enoch Pratt Library
of Baltimore City, or of any other free public library in Baltimore City,
provided, that the title or ownership of the property of every such library
or branch is vested in the said Mayor and City Council of Baltimore.

To erect, regulate, control and maintain markets and stalls within the
City of Baltimore, and to regulate and control the sale of all goods, wares,
merchandise and other articles therein. To lease, sell or dispose of any
stalls or stands in any market, in such manner and upon such terms as
it may think proper. To contract for, purchase, lease and hold to it and
its successors, in fee simple, or for a term of years, renewable from time
to time forever, any lands, tenements, and their appurtenances in the
vicinity of any market for the purpose of extending same. To condemn
any land or other property or any interest in land or other property for
market purposes in the mode provided in this Charter. To levy and
