764 ARTICLE 3.

ready been laid off or may hereafter be laid off under the provisions of
this subtitle of this Article, the owners of a majority of front feet of
ground bounding on such proposed alley may make application to the
County Commissioners in the same manner as for the condemning, open-
ing and grading of any street or avenue, or part threeof, and the width
of the proposed alley and the location of the same must be set forth in
said application; and after said application is presented to the County
Commissioners all proceedings which can be had and taken for the con-
demnation, opening, grading and construction of atny street or avenue, or
portion thereof, under the provisions of this subtitle of this Article, shall
be had and taken for the condemnation, opening, grading and construction
of such proposed alley.

638. Whenever the owners of a majority of front feet of ground bound-
ing on any street or avenue, or any portion thereof, may make application
for the condemning, opening, grading, and constructing of any street or
avenue, or part thereof, under the provisions of any of the sections of this
subtitle of this Article, they may set forth that they desire to increase the
width of said street or avenue and the manner in which they propose to
increase the same; and in condemning, opening, grading and constructing
said street or avenue, or any portion thereof, all such proceedings shall and
can be had and taken in the matter as are provided for in the case of con-
demning, opening, grading and constructing any street or avenue, or part
thereof, under the provisions of any of the sections of this subtitle of this
Article.

639. In condemning, opening, grading and constructing any street or
avenue, or part thereof, under the provisions of any of the sections of this
subtitle of this Article, the examiner or examiners shall assess the gross
amount of such damages, the probable cost of opening, grading and con-
struction and the probable amount of cost and expense of the proceedings
in the matter, including the per diem of the examiner or examiners, in
such proportions as may be fair and equitable as benefits upon all the
grounds in Baltimore County or adjacent thereto which shall, in the
opinion of the examiner or examiners, be benefited by the condemnation,
opening, grading and construction of said street or avenue, or any part
thereof.
